The Lilly’s online store at www.lillys.cz and www.lillys.eu is operated by Bc. Michal Štrkolec, Company ID (IČO) 24509230, with registered office at Ghegova 1019/1, 602 00 Brno, Czech Republic, trading under the brand Lilly’s.

2. Information on the Website

The operator takes reasonable care to ensure that the information published on the website is accurate and up to date. Nevertheless, technical, typographical or other obvious errors may occur. The operator may correct any identified error for future visits and orders.

Rights arising from contracts already concluded are governed by the relevant purchase contract, the General Terms and Conditions and the applicable laws; a general correction to the website content does not in itself amend a contract that has already been concluded.

Articles, guides and general recommendations are provided for informational purposes. For a specific product, the relevant product description, product instructions, identification, safety warnings and details confirmed in the order are particularly important.

3. Photographs, Materials and Natural Variations

Photographs are intended to represent products accurately, but colours may vary reasonably depending on screen settings, lighting conditions or the way in which the image is displayed.

Natural materials may show natural variations in grain, colour and texture. Decorations, cats and surrounding objects are not included with the product unless expressly stated otherwise for the relevant product.

These notices cannot be used to exclude liability where a product does not conform to its description or is defective.

4. Copyright and Trade Marks

Text, photographs, graphics, videos, instructions, product names, logos, the appearance of the website and other copyrighted works or distinctive signs are protected by applicable law and belong to the operator or the relevant licensors.

Without prior consent, it is in particular prohibited to systematically copy, publish, sell or modify the content, create a competing database from it or use it to promote third-party products, except where expressly permitted by law.

Ordinary sharing of a link to a publicly available page and use of content for personal, non-commercial purposes are permitted, provided that the origin of the content is not misrepresented and the rights of the operator or third parties are not infringed.

5. Automated Access

Without consent, automated means must not be used to disrupt the operation of the website, circumvent protective measures, place an excessive load on the infrastructure, obtain non-public data or systematically download content for further commercial use.

This does not affect statutory rights of search engines, security research, accessibility tools or other rights that cannot be contractually excluded.

To the extent permitted by law, the operator reserves the rights to reproduce and extract protected content and databases, including for text and data mining purposes.

6. Website Security and Prohibited Conduct

The user must not:

• distribute malicious software or code;
• attempt to gain unauthorised access to accounts, systems or personal data;
• circumvent authentication, security or access-control measures;
• use the website for fraud, harassment or other unlawful conduct;
• interfere with the availability of the service for other users.

The operator may reasonably restrict technical access where necessary to protect the website, users or the rights of third parties. Rights arising from contracts already concluded remain unaffected.

7. Third-Party Links and Services

The website may contain links, features or services provided by third parties, including Shopify, payment service providers, carriers, customer support tools, analytics services or social networks.

The operator of each third-party website is responsible for its own content and operation.

This does not relieve Lilly’s of responsibility for the delivery of goods, processing of orders, shipping, payment or any other service used by Lilly’s to perform its own contract with the customer, to the extent that Lilly’s is responsible for it under applicable law.

8. Website Availability

The operator does not guarantee uninterrupted availability of the website. Access may be temporarily restricted, in particular due to maintenance, security measures, updates or technical faults.

Temporary unavailability does not affect contracts already concluded or customers’ statutory rights.

If a technical error affects an order or payment, the customer may contact shop@lillys.cz.

9. Personal Data and Cookies

The processing of personal data is described in the separate Privacy Policy published through the online store.

The use of cookies and similar technologies is governed by the information provided in the cookie banner and the relevant cookie notice.

Analytics or marketing technologies that are not necessary for the operation of the website are activated only where there is a valid legal basis, in particular consent where required by law.

10. Reporting Infringements or Security Issues

Suspected unauthorised use of content, website vulnerabilities, fraudulent copies of the online store or misuse of the brand should be reported to shop@lillys.cz.

Please provide the page address, a description of the issue and any available supporting information or evidence. Security vulnerabilities should not be disclosed in a way that would unreasonably increase the risk to customers or other users.

11. Final Provisions

This legal notice is interpreted in accordance with the laws of the Czech Republic.

If the user or customer is a consumer whose habitual residence is in another Member State of the European Union, the choice of Czech law does not deprive them of the protection provided by mandatory legal provisions that would otherwise apply to the relevant relationship.

Nothing in this legal notice excludes or limits any liability or rights that cannot be excluded or limited under applicable law.

The current version applies to use of the website from its effective date. An amendment to this legal notice does not in itself amend a purchase contract that has already been concluded.
